Herbal medicinal products are widely used worldwide for the prevention and treatment of diseases due to their natural origin, therapeutic potential, and long history of use in traditional healthcare systems. The growing demand for herbal medicines has increased their commercial production and global trade, highlighting the need for effective regulatory frameworks to ensure their quality, safety, and efficacy. However, regulatory approaches vary among countries because herbal products are classified differently under national laws and guidelines. This review provides an overview of the regulatory framework governing herbal medicinal products, with emphasis on the laws, regulations, and compliance requirements adopted by major regulatory authorities, including the World Health Organization (WHO), the United States Food and Drug Administration (USFDA), the European Medicines Agency (EMA), and India's Ministry of AYUSH and Central Drugs Standard Control Organization (CDSCO). The review also discusses the classification of herbal medicinal products, quality control requirements, Good Agricultural and Collection Practices (GACP), Good Manufacturing Practices (GMP), licensing procedures, labeling requirements, pharmacovigilance, and post-marketing surveillance. In addition, the review highlights key regulatory challenges such as lack of standardization, adulteration, counterfeit products, limited clinical evidence, and differences in international regulations. Emerging approaches, including artificial intelligence, DNA fingerprinting, blockchain-based traceability, sustainable sourcing, and digital regulatory submissions, are also discussed as future opportunities to strengthen herbal medicine regulation. Overall, harmonized regulatory standards, robust quality assurance systems, and effective pharmacovigilance are essential to ensure the safe, effective, and consistent use of herbal medicinal products while supporting innovation, consumer confidence, and global market access.
The global herbal medicine market has grown significantly in recent years. This growth is due to increased consumer awareness of preventive healthcare, a rise in chronic diseases, and a demand for natural therapeutic products [4]. Advances in scientific research and commercialization have made herbal medicinal products more available and accepted in both developed and developing countries. However, the expanding global market has also underscored the need for effective regulatory oversight to ensure product quality and patient safety [1]. Despite their therapeutic potential, herbal medicinal products face challenges related to quality, safety, and efficacy. Differences in plant species, farming practices, harvesting methods, and manufacturing processes can impact the consistency of herbal preparations. Furthermore, issues like contamination, adulteration, poor standardization, and limited clinical evidence can threaten product safety and effectiveness [5]. These concerns highlight the need for strong regulatory systems that include quality control measures, monitoring of drug safety, and standardized manufacturing practices [6]. To tackle these challenges, regulatory authorities such as the World Health Organization (WHO), the United States Food and Drug Administration (USFDA), the European Medicines Agency (EMA), and India's Ministry of AYUSH and Central Drugs Standard Control Organization (CDSCO) have created guidelines and legal frameworks for regulating herbal medicinal products [7]. While these frameworks aim to ensure quality, safety, and efficacy, the differences in regulatory requirements pose a challenge for global harmonization. This review gives an overview of the regulatory framework for herbal medicinal products, highlighting international and Indian regulations, quality control requirements, compliance standards, drug safety monitoring, regulatory challenges, and future opportunities for improving the safe and effective use of herbal medicines.
CLASSIFICATION OF HERBAL MEDICAL PRODUCT:
Herbal medicinal products include a variety of plant-based preparations that differ in composition, use, and regulatory status. Each country classifies them according to its own rules. They are typically grouped into categories such as traditional herbal medicines, herbal medicinal products, dietary supplements, nutraceuticals, Ayurvedic, Siddha and Unani medicines, and homeopathic herbal preparations [7]

NEED OF REGULATION:
The growing use of herbal medicinal products worldwide has shown the need for strong regulatory frameworks. Even though these products are seen as natural, differences in raw materials, manufacturing, and quality can impact their safety and effectiveness. Thus, solid regulations are necessary to guarantee product quality, safety, and protection of public health.
1.Patient Safety- The primary goal of regulation for HMPs (Herbal Medicinal Products) is patients’ safety [1]. Herbal preparations can be contaminated with various undesirable chemical components including heavy metals, pesticides, microbial agents/mycotoxins/undeclared pharmaceutical substances because of substandard practices in cultivation, production, or storing. Moreover, improper usage, wrong dosages, drug-herb interactions, and lack of sufficient safety monitoring could lead to adverse consequences on human’s health condition. Therefore, regulatory agencies request that the manufacturer should abide by certain regulations including conducting safety assessment, carrying out qualitative test, developing pharmacovigilance program, or implementing post-marketing surveillance to reduce potential threats and guarantee the secure usage of drugs among individuals [2].
2.Product Quality- Quality assurance plays an important role for efficacy and safety of herbal medicines. Factors affecting growth and development of medicinal plants such as geographical area, climate condition, harvest period and processing method pose challenges towards obtaining a consistently high-quality product [3]. Regulatory bodies require companies that manufacture plant-based drug to have implemented good agricultural/collection practice (GACP) guideline, good manufacturing practices (GMP), valid analytical methodology with quality control system [2, 7].
3.Standardization- Standardization ensures batch to batch consistency of herbal medicinal product as they contains multiple biologically active compound with varying concentration. Unlike synthetic drug containing defined chemical entity, Herbal medicine are mostly composed of multitudes of biologically active compounds which may differ significantly from one plant part to another. To achieve standardization, there are many recommended protocols proposed by regulatory guidelines such as using of standardized extract, authentication of botanical material, chemical fingerprinting, identification of marker compound and validation of analytical technique. Thereby promoting their scientific evaluation and getting through regulatory approval [7].
4.Prevention of Adulteration- The presence of adulterated herbal medicinal products can be attributed to deliberate substitution of plant species, addition of synthetic pharmaceutical ingredients, contamination with toxic substances, or utilization of inferior-quality raw materials. To mitigate this challenge, regulatory authorities implement stringent quality assurance mechanisms that include raw material authentication processes, rigorous laboratory testing procedures, supplier qualification protocols, and periodic inspections to ensure adherence to quality standards and prevent the release of fraudulent herbal medicinal products into the market [2, 3].
5.Consumer Confidence- Public Trust and Confidence is a well defined regulatory framework builds consumers’ confidence towards usage of herbal medicinal products as they can be assured about manufacturing processes of such products according to the prescribed standards and proper evaluation for quality and safety. This includes clear labelling and accurate information on product and its therapeutic properties based upon scientific evidences. Systems should also ensure reporting of adverse events from usage of these medicines so as to further promote safe usage. These would also assist health care professionals and patients to safely utilize herbal medicine [1,7]
6.International Trade- The global market of herbal medical products has expanded significantly in recent decades which necessitate an imperative of setting harmonised standards of regulation globally. Differences in country-specific regulatory policies for registration, quality specification, labelling requirements and safety assessments impede the flow of these products across borders. Harmonisation of regulatory mandates by adopting internationally accepted guidelines facilitates registration of HM products, ensures greater accessibility in the global markets and encourages cross-border co-operation among regulators that can lead to increased exports of high quality herbal medical products. It also helps stimulate innovation within the sector and thereby enhances the overall competitiveness of the herbal medicine industry globally [1, 16]
GLOBAL REGULATORY FRAMEWORK:
Driven by the increasing popularity of herbal medicinal products globally, many countries have established regulations on these products to ensure their quality, safety, and efficacy. However, different regulatory approaches are used, considering that they can be categorized into various product categories such as medicines, dietary supplements, or traditional health products. To address this issue, the World Health Organization (WHO) has contributed to developing harmonized and evidence-based regulatory frameworks worldwide.
1. World Health Organization (WHO)- The WHO plays a crucial role in advocating the safe and effective use of herbal medicines worldwide by developing internationally recognized guidelines that guide national regulatory systems, despite the fact that they do not directly regulate herbal medicinal products. These guidelines advocate that herbal medicinal products should adhere to similar levels of quality, safety, and efficacy of conventional medicines. They address aspects such as the cultivation of medicinal herbs, manufacturing processes, quality controls, pharmacovigilance, and clinical evaluations of these plant extracts [1]. Furthermore, the World Health Organization (WHO) developed guidelines on good agricultural and collection practices (GACP). These regulations set specific requirements to standardize the cultivation, harvesting, processing, and storing medicinal plants to improve the quality and consistency of herbal raw materials used in producing herbal medicines [1, 2]. Additionally, WHO advocates adherence to good manufacturing practices (GMPs), which ensures that appropriate steps are taken during manufacturing, documentation, quality assurance, and control of potential contaminations [2]. Finally, WHO highlights critical points relating to the safety of the final herbal medicine product that includes implementation of comprehensive quality controls such as botanical authentication, physicochemical analyses, chromatographic fingerprints, and testing for the presence of heavy metals, pesticide residue, microorganisms, and other contaminants [3]. Moreover, WHO recommends that countries develop and implement robust pharmacovigilance systems for monitoring adverse reactions associated with herbals drugs while strengthening their capacities to monitor and regulate traditional medicines using the WHO traditional medicine strategy [1].
2.United States – Food and Drug Administration (USFDA)- United States – Food and Drug Administration (USFDA)- United states. In the US, these products fall predominantly within the category of dietary supplements as per DSHEA 1994. They are regulated by US food drug administration(FDA). The manufacturers have an obligation of product safety prior to its marketing. It should be noted however that pre-market FDA approval is generally not needed. The cGMP(Current good manufacturing practice) sets out standards relating to manufacturing process, quality control measures, sanitation practices, record keeping procedures, packaging instructions, labeling requirements and testing protocols to ensure consistent quality. Product label shall include a complete listing of all ingredients along with their respective dosages, manufacturer’s details, and safety-related data. While it is permissible to make specific types of “structure/function” statements about the potential benefits of consuming certain nutrients from herbs, making health benefit claims regarding curing/treating/preventing disease conditions is forbidden unless the item gets formalized FDA approval. The FDA oversees post-marketing activities related to adverse effects occurring due to use of dietary supplements through implementation mechanisms like sending out warning letter advisories etc[17,8].
3. European Union – European Medicines Agency (EMA)- The European Union (EU) has regulations covering the development of herbal medicines via directive 2004/24/EC which amends directive 2001/83/EC establishing an improved register system for traditional herbal medicine. The European Medicines Agency (EMA) produces scientific opinions about herbs and their therapeutic use through its committee on herbal medicinal products (HMPC). It also develops community herbal monographs as well as guidance on indications, dosage, safety, and quality requirements of herbal medicinal products [11,7]. Under the Traditional Herbal Medicinal Products Directive (THMPD), products with at least 30 years of traditional medicinal use, including 15 years within the EU, may qualify for simplified registration without extensive clinical efficacy studies. However, manufacturers must demonstrate product quality, manufacturing consistency, and safety. Manufacturers are also required to comply with Good Manufacturing Practices (GMP), pharmacopoeial standards, stability studies, and quality control tests, including botanical authentication, standardization, and contaminant testing. In addition, pharmacovigilance systems ensure continuous monitoring of adverse drug reactions and support ongoing benefit–risk evaluation of herbal medicinal products [7].
4. India – Central Drugs Standard Control Organization (CDSCO) and Ministry of AYUSH-India has a well-established regulatory framework for herbal medicinal products based on traditional systems such as Ayurveda, Siddha, Unani, Sowa-Rigpa, and Homoeopathy. Regulation is primarily carried out by the Ministry of AYUSH and the Central Drugs Standard Control Organization (CDSCO). The legal framework is provided by the Drugs and Cosmetics Act, 1940 and the Drugs and Cosmetics Rules, 1945. The Ministry of AYUSH is responsible for policy development, research, quality assurance, and pharmacopoeial standards, while official pharmacopoeias provide specifications for raw materials, formulations, and analytical methods [18,19].CDSCO regulates phytopharmaceutical drugs, which are developed from standardized plant extracts using modern scientific evidence. Manufacturers must submit data on botanical identification, manufacturing processes, quality specifications, pharmacology, toxicology, clinical studies, and stability before marketing approval [14].Quality control includes botanical authentication, physicochemical analysis, chromatographic fingerprinting, microbial testing, heavy metal and pesticide residue analysis, aflatoxin testing, and stability studies to ensure product quality and safety [14,18]. In addition, the Ministry of AYUSH oversees the National Pharmacovigilance Program for ASU&H Drugs, which monitors adverse drug reactions and supports the safe use of traditional medicines [18].

INDIAN REGULATORY FRAMEWORK:
India has one of the world's oldest and most comprehensive traditional medicine systems, including Ayurveda, Siddha, Unani, Sowa-Rigpa, and Homoeopathy (ASU&H). These systems are recognized by the Government of India and regulated through a structured legal framework designed to ensure the quality, safety, and efficacy of herbal medicinal products. The regulatory system involves multiple authorities, including the Ministry of AYUSH, the Central Drugs Standard Control Organization (CDSCO), and the Pharmacopoeia Commission for Indian Medicine & Homoeopathy (PCIM&H). Together, these organizations oversee product development, manufacturing, licensing, quality control, labeling, and post-marketing surveillance.
1.Ministry of AYUSH-The Ministry of AYUSH, established by the Government of India in 2014, is the principal authority responsible for promoting, regulating, and developing India's traditional systems of medicine. The Ministry formulates national policies, establishes quality standards, supports research and education, and coordinates activities related to Ayurveda, Yoga & Naturopathy, Unani, Siddha, Sowa-Rigpa, and Homoeopathy. It also supervises the implementation of Good Manufacturing Practices (GMP), pharmacovigilance programmes, medicinal plant conservation, and standardization initiatives. Through collaboration with research councils and state licensing authorities, the Ministry aims to improve the scientific credibility and global acceptance of Indian traditional medicines[21].
2.Central Drugs Standard Control Organization (CDSCO)-The Central Drugs Standard Control Organization functions as India's national regulatory authority for pharmaceuticals under the Directorate General of Health Services. Although classical Ayurvedic, Siddha, and Unani medicines are primarily regulated by the Ministry of AYUSH, CDSCO plays an important role in regulating phytopharmaceutical drugs developed from standardized plant extracts using modern scientific methods. Manufacturers seeking approval for phytopharmaceutical products must submit comprehensive information on botanical identification, manufacturing processes, quality specifications, pharmacological studies, toxicological data, clinical trial results, and stability studies. This regulatory pathway ensures that scientifically developed herbal products meet standards comparable to those applied to conventional pharmaceutical products[14].
3.Pharmacopoeia Commission for Indian Medicine & Homoeopathy (PCIM&H)-The Pharmacopoeia Commission for Indian Medicine & Homoeopathy (PCIM&H) functions as the national standard-setting organization for ASU&H medicines. It is responsible for developing and publishing official pharmacopoeias, formularies, monographs, and analytical methods for medicinal plants and traditional formulations. The Commission establishes standards for identity, purity, strength, quality, and analytical testing of herbal raw materials and finished products. It also supports laboratory quality assurance, reference standards, and scientific validation to promote uniformity in manufacturing and quality control across the herbal medicine industry[22].
4.Drugs and Cosmetics Act, 1940-The Drugs and Cosmetics Act, 1940, serves as the primary legislation governing the manufacture, distribution, sale, and quality control of drugs and cosmetics in India. Chapter IVA of the Act specifically addresses Ayurvedic, Siddha, and Unani medicines. The Act defines regulatory requirements for licensing, quality standards, inspection of manufacturing facilities, and penalties for the manufacture or sale of misbranded, adulterated, or spurious products. It also empowers regulatory authorities to inspect manufacturing premises, collect product samples, and enforce compliance with statutory provisions[19].
5.Drugs and Cosmetics Rules, 1945-The Drugs and Cosmetics Rules, 1945, provide detailed procedures for implementing the provisions of the Drugs and Cosmetics Act. The Rules specify requirements for manufacturing licenses, product labeling, record maintenance, storage conditions, quality control laboratories, and inspection procedures. They also prescribe standards for manufacturing facilities, equipment, documentation, personnel qualifications, and hygiene practices necessary to ensure consistent product quality. Compliance with these Rules is mandatory for manufacturers of Ayurvedic, Siddha, and Unani medicines[19].
6.Good Manufacturing Practices (Schedule T)-Schedule T of the Drugs and Cosmetics Rules establishes Good Manufacturing Practices (GMP) specifically for Ayurvedic, Siddha, and Unani medicines. It outlines requirements relating to factory design, sanitation, equipment qualification, environmental control, documentation, quality assurance, personnel training, raw material handling, in-process quality control, packaging, labeling, and storage. GMP compliance minimizes contamination, prevents manufacturing errors, and promotes batch-to-batch consistency. Regulatory inspections are conducted periodically to verify continued compliance with Schedule T requirements[19].
7.Licensing Procedures-Manufacturers intending to produce herbal medicinal products in India must obtain manufacturing licenses from the respective State Licensing Authorities. The licensing process generally involves submission of prescribed application forms, details of manufacturing premises, technical personnel qualifications, quality control facilities, equipment specifications, product formulations, and compliance with Good Manufacturing Practices. Regulatory authorities conduct inspections before granting approval. Licenses are renewed periodically following satisfactory regulatory review and continued compliance with statutory requirements[19].
8.Labeling Requirements-Proper labeling is essential for ensuring safe use and traceability of herbal medicinal products. Indian regulations require product labels to include the product name, complete list of ingredients, dosage form, batch number, manufacturing license number, manufacturing and expiry dates, net quantity, storage instructions, manufacturer's details, recommended dosage, and applicable cautionary statements. Labels must not contain misleading information or unsupported therapeutic claims. Accurate labeling enhances product transparency and enables consumers to make informed healthcare decisions[19]
9.Advertising Regulations-The advertising of herbal medicinal products in India is regulated to prevent misleading therapeutic claims and protect consumers from false or exaggerated advertisements. The Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954, prohibits advertisements claiming miraculous cures for specified diseases and disorders. Manufacturers are required to ensure that promotional materials are truthful, scientifically justifiable, and consistent with approved indications. Regulatory authorities may initiate legal action against advertisements that violate statutory provisions or mislead consumers regarding product efficacy[23].
QUALITY CONTROL REQUIREMENTS:
Quality control is a fundamental component of the regulatory framework for herbal medicinal products. Unlike synthetic drugs, herbal medicines are derived from biological sources whose chemical composition may vary due to differences in plant species, geographical origin, cultivation practices, harvesting time, and processing methods. Such variability can significantly influence the safety, efficacy, and consistency of herbal products. Therefore, regulatory authorities require comprehensive quality control measures throughout the product life cycle, beginning with raw material procurement and continuing through manufacturing, packaging, and post-marketing surveillance.
1.Authentication of Raw Materials-The quality of herbal medicinal products depends largely on the authenticity of the raw plant materials used during manufacturing. Authentication involves verifying that the correct medicinal plant species and plant part have been selected according to official pharmacopoeial standards. Incorrect identification or substitution of plant materials may result in reduced therapeutic activity or adverse health effects. Authentication is performed using macroscopic examination, microscopic analysis, organoleptic evaluation, chemical profiling, and modern molecular techniques. Proper authentication minimizes adulteration and ensures consistency in herbal formulations[2,3].
2.Botanical Identification-Accurate botanical identification is essential for distinguishing medicinal plants from morphologically similar or adulterant species. Identification is generally based on scientific taxonomy, herbarium voucher specimens, botanical descriptions, and diagnostic morphological characteristics such as leaves, flowers, fruits, seeds, and roots. Microscopic examination of cellular structures and histological features further confirms plant identity. Correct botanical identification forms the foundation of quality assurance and prevents the accidental use of toxic or ineffective plant materials[3,7]
3.Good Agricultural and Collection Practices (GACP)-Good Agricultural and Collection Practices (GACP) are internationally recognized guidelines developed to ensure the production of high-quality medicinal plant materials. GACP covers the selection of cultivation sites, propagation methods, irrigation, fertilizer application, pest management, harvesting techniques, drying, storage, transportation, and documentation. Proper implementation of GACP minimizes contamination by pesticides, heavy metals, microorganisms, and environmental pollutants while preserving the concentration of bioactive constituents. Adoption of GACP also improves traceability and sustainability in the herbal medicine supply chain[2].
4.Good Manufacturing Practices (GMP)-Good Manufacturing Practices (GMP) ensure that herbal medicinal products are consistently manufactured and controlled according to established quality standards. GMP requirements include qualified personnel, validated manufacturing processes, appropriate equipment, sanitation, environmental monitoring, documentation, quality assurance, packaging, labeling, and storage. Compliance with GMP reduces manufacturing errors, prevents cross-contamination, and promotes batch-to-batch consistency. Regulatory inspections are conducted periodically to verify compliance with GMP standards[2,19].
5.Standardization-Standardization is a critical quality assurance strategy used to minimize natural variability in herbal medicinal products. It involves establishing consistent specifications for raw materials, manufacturing processes, marker compounds, and finished products. Standardization techniques include chromatographic fingerprinting, quantitative estimation of bioactive constituents, physicochemical testing, and validation of analytical methods. These approaches ensure that each production batch contains comparable levels of therapeutically active constituents, thereby improving product reproducibility, efficacy, and safety[7,24].
6.Stability Studies-Stability studies are conducted to determine the shelf life of herbal medicinal products and to evaluate the effect of environmental factors such as temperature, humidity, and light on product quality. These studies assess physical appearance, moisture content, chemical stability, microbial quality, and potency throughout the storage period. Stability testing enables manufacturers to establish appropriate storage conditions, packaging requirements, and expiry dates, thereby ensuring that herbal products remain safe and effective until the end of their intended shelf life[19,24].
7.Heavy Metal Testing-Medicinal plants may accumulate toxic heavy metals from contaminated soil, irrigation water, fertilizers, or industrial pollution. Heavy metals such as lead, arsenic, cadmium, and mercury pose significant health risks when present above permissible limits. Regulatory guidelines therefore require routine testing of herbal raw materials and finished products using validated analytical techniques such as Atomic Absorption Spectroscopy (AAS), Inductively Coupled Plasma–Mass Spectrometry (ICP-MS), or Inductively Coupled Plasma–Optical Emission Spectrometry (ICP-OES). Products exceeding regulatory limits are considered unsuitable for therapeutic use[3,24].
8.Microbial Testing-Microbial contamination may occur during cultivation, harvesting, processing, storage, or transportation of herbal materials. The presence of pathogenic microorganisms can compromise product quality and endanger patient safety. Quality control laboratories therefore perform microbial limit tests to determine total bacterial count, fungal count, and the absence of specified pathogens such as Escherichia coli, Salmonella spp., Staphylococcus aureus, and Pseudomonas aeruginosa. Compliance with microbial quality standards is essential before herbal medicinal products are released for commercial distribution[3,24].
9.Pesticide Residue Analysis-The use of pesticides during cultivation may leave harmful residues in medicinal plants. Excessive pesticide residues may produce toxic effects and reduce the safety of herbal medicinal products. International regulatory agencies recommend routine monitoring of pesticide residues using chromatographic techniques such as Gas Chromatography–Mass Spectrometry (GC-MS) and Liquid Chromatography–Mass Spectrometry (LC-MS). Adherence to maximum residue limits established by regulatory authorities ensures consumer safety and facilitates international trade[3,2].
10.DNA Barcoding: A Modern Approach to Quality Control-DNA barcoding has emerged as an advanced molecular technique for the authentication of medicinal plant species. Unlike conventional morphological identification, DNA barcoding uses short, standardized DNA sequences to accurately identify plant species regardless of their developmental stage or physical condition. Common genetic markers include rbcL, matK, ITS, and psbA-trnH regions. DNA barcoding is particularly valuable for detecting adulteration, identifying substituted species, authenticating processed herbal materials, and supporting regulatory quality assurance programmes. Integration of DNA barcoding with conventional analytical methods has significantly strengthened the reliability and traceability of herbal medicinal products[25,26].
SAFETY AND PHARMACOVIGILANCES:
The widespread use of herbal medicinal products has increased the need for effective safety monitoring and pharmacovigilance systems. Although herbal medicines are generally perceived as natural and safe, they may produce adverse effects because of intrinsic toxicity, contamination, adulteration, inappropriate use, excessive dosage, or interactions with conventional medicines. Variability in plant composition and the presence of multiple bioactive constituents further complicate safety assessment. Consequently, regulatory authorities emphasize continuous monitoring throughout the product life cycle to ensure that the benefits of herbal medicinal products outweigh their potential risks.
1.Adverse Drug Reactions (ADRs)-Adverse drug reactions (ADRs) associated with herbal medicinal products are unintended and harmful responses that occur when these products are used at recommended doses. The occurrence of ADRs may be influenced by patient-related factors, including age, genetics, underlying diseases, pregnancy, concomitant medications, and duration of therapy. Common adverse reactions include allergic responses, gastrointestinal disturbances, hepatotoxicity, nephrotoxicity, dermatological reactions, and cardiovascular effects. In some cases, serious toxicity has been reported following prolonged use, overdose, or consumption of contaminated or adulterated herbal preparations. Healthcare professionals, manufacturers, and consumers are encouraged to report suspected adverse reactions to national pharmacovigilance centres. Systematic collection and evaluation of ADR reports allow regulatory authorities to identify emerging safety signals, update product information, and implement risk minimization strategies. Continuous ADR monitoring contributes significantly to improving patient safety and supporting evidence-based regulatory decision-making[5,27].
2.Herb–Drug Interactions-Herbal medicinal products are frequently used alongside prescription medicines, increasing the possibility of herb–drug interactions. These interactions may alter the pharmacokinetics or pharmacodynamics of conventional drugs, leading to reduced therapeutic efficacy or increased toxicity. Certain herbal products can induce or inhibit drug-metabolizing enzymes, particularly cytochrome P450 enzymes, and drug transport proteins such as P-glycoprotein. For example, St. John's Wort may reduce the effectiveness of oral contraceptives, immunosuppressants, anticoagulants, and antiretroviral medicines by inducing CYP3A4 enzymes. Similarly, Ginkgo biloba, garlic, and ginseng may increase the risk of bleeding when administered with anticoagulants such as warfarin. Awareness of these interactions is essential for healthcare professionals to ensure the safe and rational use of herbal medicines. Appropriate patient counselling and medication history are important components of pharmacovigilance programmes[5,28].
3.Toxicity Evaluation-Comprehensive toxicity evaluation is necessary to establish the safety profile of herbal medicinal products before clinical use. Toxicological assessment includes studies on acute toxicity, subacute toxicity, subchronic toxicity, chronic toxicity, reproductive toxicity, developmental toxicity, mutagenicity, genotoxicity, carcinogenicity, and organ-specific toxicity. These investigations help determine safe dosage ranges, identify target organ toxicity, and evaluate potential long-term health risks. In addition to evaluating the herbal ingredients themselves, toxicity assessment should include testing for contaminants such as heavy metals, pesticide residues, microbial contamination, mycotoxins, and residual solvents. Regulatory authorities recommend that toxicity studies follow internationally accepted guidelines to ensure reliable and reproducible results. Scientific toxicity evaluation supports regulatory approval and contributes to the safe clinical use of herbal medicinal products[27,29].
4.Post-Marketing Surveillance-Pre-marketing evaluation cannot identify every potential safety issue because rare adverse reactions and long-term effects may become apparent only after widespread clinical use. Therefore, post-marketing surveillance serves as an essential component of herbal medicine regulation. It involves continuous monitoring of product safety following commercialization through spontaneous adverse event reporting, observational studies, product quality monitoring, literature review, and periodic safety evaluations. Information obtained during post-marketing surveillance assists regulatory authorities in detecting new safety signals, identifying quality defects, updating prescribing information, issuing safety warnings, restricting product use, or withdrawing products from the market when necessary. Effective post-marketing surveillance also enhances public confidence in herbal medicinal products by ensuring that potential risks are promptly recognized and managed[1,27].
5.Pharmacovigilance Programme-Pharmacovigilance is defined as the science and activities related to the detection, assessment, understanding, and prevention of adverse effects or other medicine-related problems. The principles of pharmacovigilance are equally applicable to herbal medicinal products because their safety profiles continue to evolve after marketing. The World Health Organization encourages all member countries to integrate herbal medicines into their national pharmacovigilance systems. In India, the National Pharmacovigilance Programme for ASU&H Drugs, coordinated by the Ministry of AYUSH through the Intermediary Pharmacovigilance Centres and Peripheral Pharmacovigilance Centres, monitors adverse drug reactions associated with Ayurvedic, Siddha, Unani, and Homoeopathic medicines. The programme promotes spontaneous reporting by healthcare professionals, evaluates causality, develops safety databases, and supports regulatory decision-making. An effective pharmacovigilance system contributes to improved patient safety, early identification of safety concerns, rational prescribing practices, regulatory transparency, and continuous improvement of herbal medicinal product quality. Strengthening pharmacovigilance through digital reporting systems, international collaboration, and increased awareness among healthcare professionals will further enhance the safe use of herbal medicines globally[1,18,27].
COMPLIANCE REQUIREMENTS:
Regulatory compliance is essential to ensure that herbal medicinal products are consistently manufactured, distributed, and marketed according to established legal and quality standards. Compliance requirements cover all stages of a product's life cycle, from procurement of raw materials to post-marketing activities. Adherence to regulatory requirements not only safeguards public health but also facilitates market authorization, international trade, and consumer confidence. Manufacturers are expected to establish robust quality management systems supported by appropriate documentation, quality assurance practices, risk management strategies, and regular regulatory inspections.
1.Documentation-Comprehensive documentation is the foundation of regulatory compliance for herbal medicinal products. Every stage of manufacturing, testing, storage, distribution, and quality control should be supported by accurate and traceable records. Essential documents include standard operating procedures (SOPs), specifications for raw materials and finished products, manufacturing formulas, analytical methods, equipment maintenance records, validation reports, training records, stability data, and complaint records. Proper documentation promotes traceability, facilitates product recall when necessary, and demonstrates compliance during regulatory inspections. Accurate record-keeping also minimizes human error and supports continuous quality improvement through systematic review of manufacturing processes[2,30].
2.Licensing-Manufacturers of herbal medicinal products must obtain the necessary licenses from the competent regulatory authority before commencing commercial production. Licensing requirements generally include submission of manufacturing site information, details of technical personnel, quality control facilities, manufacturing processes, product formulations, and evidence of compliance with Good Manufacturing Practices (GMP). Regulatory authorities evaluate the submitted information and conduct inspections before granting manufacturing authorization. Licenses are subject to periodic renewal and may be suspended or cancelled if manufacturers fail to comply with applicable legal requirements. Licensing systems ensure that only qualified manufacturers are permitted to produce herbal medicinal products for public use[2,19].
3.Good Manufacturing Practice (GMP) Compliance-Good Manufacturing Practice (GMP) is one of the most important regulatory requirements governing herbal medicinal products. GMP ensures that products are consistently manufactured under controlled conditions to achieve predefined standards of quality, safety, and consistency. Compliance includes appropriate facility design, qualified personnel, equipment qualification, sanitation, environmental monitoring, process validation, documentation, quality control, and corrective and preventive actions (CAPA). Implementation of GMP reduces the possibility of contamination, mix-ups, product defects, and manufacturing errors. Continuous GMP compliance is verified through internal audits and inspections conducted by regulatory authorities[2,30].
4.Batch Records-Batch manufacturing records provide complete documentation for every production batch of a herbal medicinal product. These records include information on raw material identity, quantities used, processing parameters, equipment employed, in-process quality control results, packaging details, personnel involved, deviations observed, and final product release. Batch records ensure complete traceability throughout the manufacturing process and enable manufacturers to investigate quality defects or product complaints efficiently. Regulatory authorities require these records to be retained for a specified period to support inspections, product recalls, and pharmacovigilance activities[2,14].
5.Quality Assurance-Quality assurance (QA) is a systematic approach that ensures herbal medicinal products consistently meet predefined quality standards. QA encompasses supplier qualification, raw material inspection, process validation, quality control testing, stability evaluation, documentation review, change control, deviation management, and product release procedures. An effective quality assurance system integrates all manufacturing activities to ensure compliance with regulatory requirements while promoting continuous process improvement. Independent quality assurance personnel play a critical role in reviewing manufacturing records and authorizing product release only after satisfactory evaluation of quality parameters[2,31].
6.Audits-Regulatory compliance is periodically verified through internal and external audits. Internal audits are conducted by manufacturers to evaluate adherence to established procedures, identify deficiencies, and implement corrective actions. External audits are performed by regulatory agencies, certification bodies, or customers to assess compliance with legal requirements and quality management systems. Audit findings provide valuable information regarding manufacturing practices, documentation accuracy, personnel training, facility maintenance, and overall regulatory compliance. Regular audits contribute to continuous quality improvement and help organizations maintain inspection readiness[2,31]
7.Risk Management-Risk management is an integral component of modern pharmaceutical quality systems. It involves the systematic identification, assessment, control, communication, and review of risks that may affect product quality or patient safety. In herbal medicinal products, potential risks include variability in raw materials, contamination, adulteration, manufacturing deviations, labeling errors, and supply chain disruptions. Risk management tools such as Failure Mode and Effects Analysis (FMEA), Hazard Analysis, and risk assessment matrices help manufacturers prioritize quality issues and implement appropriate preventive measures. Adoption of a risk-based approach enhances regulatory compliance and supports continuous improvement of manufacturing processes[32].
8.Import and Export Regulations-International trade in herbal medicinal products requires compliance with both domestic regulations and the regulatory requirements of importing countries. Exporters must ensure that products satisfy applicable standards relating to quality, safety, labeling, packaging, documentation, and certification. Depending on the destination country, manufacturers may also be required to provide Certificates of Pharmaceutical Product (CPP), Certificates of Analysis (CoA), phytosanitary certificates, free sale certificates, or evidence of compliance with Good Manufacturing Practices. Import regulations often include customs documentation, inspection procedures, product registration requirements, and verification of compliance with national pharmacopoeial standards. Harmonization of regulatory requirements through international guidelines facilitates global market access and promotes international trade in herbal medicinal products[2,16,30].
CHALLENGES IN THE REGULATION OF HERBAL MEDICAL PRODUCTS:
Despite significant advancements in the regulation of herbal medicinal products, several scientific, regulatory, and technical challenges continue to hinder their safe and effective use. Differences in regulatory policies, inadequate quality control, limited scientific evidence, and insufficient pharmacovigilance systems often affect the reliability and global acceptance of herbal medicines. Addressing these challenges requires coordinated efforts among regulatory authorities, researchers, manufacturers, and healthcare professionals.
1.Lack of Standardization-One of the major challenges associated with herbal medicinal products is the lack of standardization. Unlike synthetic medicines, herbal products contain multiple bioactive constituents whose concentrations may vary depending on plant species, geographical origin, climatic conditions, cultivation practices, harvesting time, and processing methods. Such variability can result in inconsistent therapeutic outcomes and difficulties in quality assessment. Standardization involves establishing uniform specifications for raw materials, manufacturing processes, analytical methods, and finished products. However, achieving complete standardization remains difficult because many herbal constituents responsible for therapeutic activity have not been fully identified. The absence of universally accepted quality standards further complicates regulatory evaluation and international acceptance of herbal medicinal products[1,3].
2.Variable Regulations Among Countries-Regulatory approaches for herbal medicinal products differ considerably across countries. While some nations regulate herbal products as pharmaceutical medicines, others classify them as dietary supplements, traditional medicines, health products, or foods. Consequently, the requirements for product registration, quality evaluation, safety assessment, efficacy data, labeling, and marketing authorization vary substantially between regulatory jurisdictions. These regulatory differences create challenges for manufacturers seeking international market approval, increase compliance costs, and delay product registration. The lack of globally harmonized regulatory standards also limits international trade and complicates regulatory cooperation among national authorities. Greater international harmonization would facilitate product development and improve global access to safe and effective herbal medicines[1,7].
3.Adulteration-Adulteration remains one of the most serious quality concerns in the herbal medicine industry. Herbal products may be intentionally or unintentionally adulterated through substitution of plant species, addition of synthetic pharmaceutical ingredients, contamination with toxic chemicals, or inclusion of inferior-quality raw materials. Such practices compromise product quality, reduce therapeutic effectiveness, and may expose consumers to significant health risks. Detection of adulteration has become increasingly important because many adulterants cannot be identified through simple visual inspection. Advanced analytical techniques such as chromatographic fingerprinting, DNA barcoding, spectroscopy, and chemical profiling are now widely used to authenticate herbal materials and detect fraudulent substitutions. Strengthening quality control systems and regulatory inspections is essential to minimize adulteration within the herbal medicine supply chain[3,26].
4.Counterfeit Products-The growing global demand for herbal medicinal products has led to an increase in counterfeit and illegally marketed products. Counterfeit herbal medicines may contain incorrect ingredients, insufficient quantities of active constituents, harmful contaminants, or misleading labeling. These products are frequently manufactured under poor-quality conditions and bypass regulatory oversight, posing serious risks to public health. Weak enforcement mechanisms, inadequate market surveillance, and online sales platforms have further increased the circulation of counterfeit herbal products. Strengthening licensing procedures, implementing serialization and traceability systems, and increasing regulatory inspections are important strategies for reducing counterfeit medicines and protecting consumers[3,26].
5.Limited Clinical Evidence-Although many herbal medicinal products have a long history of traditional use, scientific evidence supporting their clinical efficacy remains limited for numerous formulations. Many available studies involve small sample sizes, inadequate study design, lack of standardization, or insufficient long-term follow-up. Consequently, regulatory authorities often face difficulties in evaluating the therapeutic claims made by manufacturers. High-quality randomized controlled trials, systematic reviews, pharmacokinetic investigations, and real-world evidence are required to establish the efficacy and safety of herbal medicinal products according to modern scientific standards. Expanding clinical research will strengthen regulatory decision-making and increase confidence among healthcare professionals and patients[1,6].
6.Weak Pharmacovigilance Systems-Effective pharmacovigilance is essential for detecting adverse reactions and monitoring the long-term safety of herbal medicinal products. However, pharmacovigilance systems for herbal medicines remain underdeveloped in many countries. Underreporting of adverse events, lack of awareness among healthcare professionals, inadequate reporting mechanisms, and difficulties in identifying herbal ingredients contribute to incomplete safety data. Strengthening pharmacovigilance requires improved reporting systems, standardized adverse event documentation, healthcare professional training, public awareness programmes, and international collaboration. Integration of herbal medicines into national pharmacovigilance programmes and the use of digital reporting platforms can significantly enhance the early detection of safety concerns and improve regulatory oversight[1,18].
Overall, overcoming these challenges requires stronger regulatory cooperation, harmonization of international guidelines, improved quality control technologies, increased scientific research, and enhanced pharmacovigilance systems. Addressing these issues will contribute to the development of safer, more effective, and globally accepted herbal medicinal products.
FUTURE PERSPECTIVE
The future regulation of herbal medicinal products is expected to become more science-based and technology-driven. Advances in analytical methods, digital technologies, and international cooperation will strengthen quality assurance, improve patient safety, and facilitate global acceptance of herbal medicines. Artificial intelligence (AI) has the potential to improve the quality assessment of herbal products by analyzing complex data, detecting adulteration, predicting product stability, and supporting decision-making during quality control. AI-based tools can increase the accuracy and efficiency of regulatory evaluations[1].Blockchain technology can improve traceability throughout the herbal medicine supply chain by securely recording information from cultivation to distribution. This approach enhances product transparency, reduces the risk of counterfeit medicines, and increases consumer confidence[2].The harmonization of international regulations is essential to reduce differences in product registration, quality standards, and safety requirements among countries. Greater collaboration between regulatory agencies can simplify global marketing and promote consistent regulatory practices[1]. Digital regulatory submissions, including electronic Common Technical Document (eCTD) systems, are expected to make the regulatory review process faster, more transparent, and more efficient. Electronic documentation also improves data management and communication between manufacturers and regulatory authorities[33].Sustainable sourcing of medicinal plants is becoming increasingly important to protect biodiversity and ensure the long-term availability of herbal raw materials. Adoption of Good Agricultural and Collection Practices (GACP) and responsible cultivation methods will support sustainable production[2].
DNA fingerprinting is an emerging molecular technique that provides accurate identification of medicinal plant species. It helps detect adulteration, authenticate raw materials, and strengthen quality control, making it an important tool for future regulatory systems[26].International collaboration among governments, regulatory agencies, researchers, and the herbal medicine industry will play a key role in developing harmonized guidelines, improving pharmacovigilance, and encouraging scientific research. Such cooperation will contribute to safer, high-quality, and globally accepted herbal medicinal products[1].
CONCLUSION
Herbal medicinal products continue to play an important role in global healthcare, making robust regulatory frameworks essential to ensure their quality, safety, and efficacy. Effective regulations governing the cultivation, manufacturing, quality control, licensing, labeling, and post-marketing surveillance of herbal products help protect public health and strengthen consumer confidence. Although considerable progress has been made by organizations such as the World Health Organization (WHO), the U.S. Food and Drug Administration (USFDA), the European Medicines Agency (EMA), and the Ministry of AYUSH and CDSCO in India, differences in regulatory requirements among countries remain a major challenge for global harmonization and international trade. Future regulatory systems should focus on harmonized standards, stronger pharmacovigilance programmes, improved quality assurance, and the adoption of emerging technologies such as artificial intelligence, DNA barcoding, blockchain-based traceability, electronic regulatory submissions, and Quality by Design (QbD). In addition, sustainable sourcing of medicinal plants and international collaboration among regulatory agencies, researchers, and industry stakeholders will be crucial for conserving biodiversity and ensuring a reliable supply of high-quality herbal raw materials. Collectively, these advancements will support the development of safer, more effective, scientifically validated, and globally accepted herbal medicinal products, thereby enhancing public health and promoting the sustainable growth of the herbal medicine sector.
